FAQ:

What is the deadline for filing an appeal after being notified of the rejection of a naturalization application?

You have 10 (ten) days to file your appeal against the rejection of your naturalization application, counted from the date you received the notification by email, from your access to the platform, or from the publication of the decree in the Diário Oficial da União.

After this deadline, the rejection of naturalization can only be challenged in court. Or you can file a new request.

What is the timeframe for an appeal to be reviewed by the Ministério da Justiça e Segurança Pública?

By law, the timeframe is 30 days, which can be extended to up to 60 days if there is just cause.

However, due to high demand, the average time has been 5 months. If there is no decision within this timeframe, it is possible to file a lawsuit alleging non-compliance with the law.

What documents are needed?

The required documentation varies depending on the case, and additional documents may be submitted at the time of the appeal.

Every appeal includes a brief explanation of why the decision was incorrect, as well as demonstrating to the authority that the foreigner meets the requirements stipulated in the Migration Law (Law 13.445/2017).

What can be done if the appeal is denied again?

The foreigner can file a new administrative appeal, or if they have fulfilled all the requirements of the Migration Law and their naturalization request was still denied, it is possible to file a lawsuit.

Are there any guarantees that the appeal will change the denial decision?

There are no guarantees.

However, our firm only presents defenses in cases where we believe the client has met all the requirements imposed by law, which guarantees us a high success rate..
