Dutch citizenship: understand the three exceptions that allow you to recover Brazilian citizenship

Many Brazilians who obtained Dutch citizenship were required to formally renounce their Brazilian nationality because of Dutch law.

That is because, when someone over 18 seeks naturalization as Dutch, they are generally obliged to renounce any other nationality. However, there are three little-known exceptions to this general rule.

If you were a native-born Brazilian, renounced your Brazilian citizenship to obtain Dutch citizenship, you may — under certain conditions — request to recover your Brazilian nationality while retaining your Dutch citizenship, if you fall under one of the following categories:

  1. You are a former native-born Brazilian currently residing in Brazil;

  2. You are a former native-born Brazilian who lived continuously in Brazil for at least five years before turning 18;

  3. You are a former native-born Brazilian currently married to a Brazilian (either native-born or naturalized).

Moreover, at the end of 2023, there was a change in Brazilian Federal Constitution that allows — in certain cases — a native-born Brazilian to request the revocation of the act that declared the loss of Brazilian nationality.

If you renounced your Brazilian citizenship to acquire Dutch citizenship and want to reverse that decision, you should consult an immigration lawyer to analyze whether you meet one of these three exceptions.
