The vast majority of denied ordinary naturalization requests submitted by foreigners in Brazil are not due to failure in meeting the requirements established by the Migration Law. Instead, they are most often caused by mistakes or lack of attention during the analysis of the documentation submitted to the Ministry of Justice and Public Security.
That’s why, if your documentation is complete, we strongly recommend seeking assistance from a migration law specialist to help you draft your administrative appeal. This step is essential to prepare your case properly in case you later need to file a judicial petition.
If you're unsure whether your documentation is in order, we suggest reading this article:“What Are the Requirements to Become a Naturalized Brazilian Citizen? Step-by-Step Guide for Ordinary Naturalization.”
Administrative Appeal After Naturalization Denial
It’s important to know that you have 10 (ten) days to submit your appeal after receiving the denial notice—this period begins from the date you received the notification via email or accessed the online platform.
Your administrative appeal must be written in Portuguese, clearly stating the date you became aware of the denial, and must include all your personal details, especially your National Migration Registry Number and Naturalization Process Number.
Clearly explain why the decision is incorrect and specify that all required documents were submitted. If necessary, include any additional or missing documents with your appeal.
