Differences in regularizing your Brazilian documents
Surname change due to marriage to a U.S. citizen
In these cases, we need to review your foreign marriage certificate. Regardless of whether the surname change is stated on it or not, we can register the annotation directly with the Civil Registry Office, with no need for a court case.
This process is carried out at a Civil Registry Office in Brazil and takes an average of 30 days to complete, including the time to update your other documents (CPF and Voter ID).
What changes is how the request is filed and which documents are required.
If you've already registered the marriage at the Consulate, or even had it transcribed in Brazil, the change is still possible. To find out which procedure best fits your situation, contact us through our service quote.
Surname change due to U.S. citizenship alone
In these cases, a court case must be filed in Brazil requesting the judicial rectification of all your civil records, since Brazilian Registry Offices cannot make this change directly — only by court order.
If your U.S. citizenship process went through a Judicial Court, it will be recognized in Brazil by the Superior Court of Justice (STJ).
If your U.S. citizenship process went through the agency responsible for Immigration Services, you will need to file a rectification action with a State Court of Justice in Brazil.
To find out which procedure best fits your situation, contact us through our service quote or schedule a consultation with one of our lawyers.
